A-1 Computer Service will not be held responsible for any typographical errors in our website, any related website or any of our promotional materials. Information is provided for our customers benefit and A-1-Computer-Service will not be held responsible for any damages (direct or indirect) caused by any information and/or software provided in any of our web site pages, promotional materials, and/or lost data or any damage resulting from a support session. We cannot be held responsible for a computer in a previously unknown condition. Such a computer could be in a condition of imminent failure and, as such, could fail during a support session and appear to have been caused by the support session. Although our support technicians take precautions, there is always a risk, however small, of accidental data loss. By purchasing support from A-1 Computer Service, you agree to all the terms of service herein and assume all risks. Also, A-1 Computer Service will not be held responsible for any damages caused by the services of any third-party software providers recommended by us or yourself. A-1 Computer Service support services only cover computer problems that can be fixed remotely. Some computer problems cannot be fixed online. Our support services Do NOT cover the cost of replacement parts, software, labor, or services from third-party service providers. If unable to correct your problem online then A-1 Computer Service has the capability of repairing your computer at our repair facility at varied prices. Price will be quoted to customer prior to customer bringing their computer to our repair facility.

Availability
A-1 Computer Service cannot guarantee the availability of tech support since we have no control of internet outages, service providers, hosting servers, etc. If for some unforeseen reason beyond our control we cannot provide support at your scheduled appointment time, we will contact you by phone and make arrangements to reschedule. If we have a high volume of support requests, a support technician might not be available for immediate assistance. In such a case, we will put you on a waiting list and notify you by phone as soon as a support technician is available to assist you. You will also have the option to schedule an appointment should this time not be convenient to you. A-1 Computer Service will not be held responsible for any damages (direct or indirect) caused by late and/or missed service appointments.


Privacy
A-1 Computer Service greatly values your privacy. Any information we collect from our customers is solely for our own internal use and we do not give this information out to any third party.

Acceptance of Policy
By using A-1 Computer Service, you signify your acceptance of this Policy Statement. If you do not agree or are not comfortable with any policy described in this Privacy Statement, your only remedy is to not use the services of A-1 Computer Service. We reserve the right to modify this Policy Statement at any time. Your continued use of any portion of A-1 Computer Service, following notification or posting of such changes, will constitute your acceptance of those changes. Warranty. In Servicing Your Computer
A-1 Computer Service warrants that service will be performed in a professional and timely manner. All remote services are warranted for a period of 7 days at the discretion of A-1 Computer Service. There is NO warranty for removal of viruses, spyware, adware or mailware; if they are the cause of a repeat effort, you will be charged again for that service.

THIS WARRANTY AND REMEDY ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, WITH RESPECT TO ANY AND ALL SERVICES PERFORMED FOR YOU BY A-1 COMPUTER SERVICE. A-1 COMPUTER SERVICE SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES WITH RESPECT TO SUCH ITEMS, INCLUDING,WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WHETHER EXPRESS OR IMPLIED. IF A-1 COMPUTER SERVICE CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS LIMITED WARRANTY ONLY. Limitation of Liability. IF ANY DAMAGE SHOULD OCCUR WHILE YOUR COMPUTER OR SYSTEMS ARE BEING SERVICED, A-1 COMPUTER SERVICE HAS NO LIABILITY FOR THE COST OF REPAIR OF THE AFFECTED COMPUTER. A-1 COMPUTER SERVICE'S ENTIRE LIABILITY TO YOU FOR DAMAGES ARISING FROM ANY CAUSE WHATSOEVER WITH RESPECT TO THE SERVICE OF YOUR COMPUTER, WHETHER DUE TO A-1 COMPUTER SERVICE'S ERROR OR NEGLIGENCE OR TO ANY OTHER REASON, IS LIMITED TO THE AMOUNTS THAT YOU PAY A-1 COMPUTER SERVICE FOR SUCH SERVICE. A-1 COMPUTER SERVICE HAS NO LIABILITY WHATSOEVER FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF USE, LOST PROFITS OR REVENUE, OR ANY OTHER DAMAGES WHATSOEVER NOT OTHERWISE EXPRESSLY PERMITTED UNDER THIS AGREEMENT. A-1 COMPUTER SERVICE EXPRESSLY HAS NO LIABILITY FOR LOSS OF OR DAMAGE TO DATA OR SOFTWARE APPLICATIONS WHILE PERFORMING SERVICE. YOUR ONLY REMEDY UNDER THE REPAIR TERMS AND CONDITIONS IS TO SEEK RECOVERY OF DAMAGES AGAINST A-1 COMPUTER SERVICE IN AN AMOUNT NOT TO EXCEED WHAT YOU PAID A-1 COMPUTER SERVICE FOR THE SERVICE.

Data Protection. You agree and understand that it is your (the customer's) responsibility to maintain copies of all important data on your computer, and to obtain such copies prior to authorizing A-1 Computer Service to commence its services for you.
This agreement shall be construed under the laws of the State of Arizona. In the event any dispute arises under this agreement or in any manner concerning the subject matter thereof, the parties agree that any such dispute shall be subject to binding arbitration only, and the parties expressly waive any and all rights they may have to otherwise proceed with such dispute resolution in a court of law.

Any and all binding arbitration proceedings shall be undertaken as "fast track" proceedings and shall only be commenced in Yavapai County, Arizona. Each party shall bear its own costs and expenses of such proceedings, including any and all resulting attorney fees; provided, however, that the prevailing party in such proceedings may have the right to recover attorney fees against the opposing
party if such fees are otherwise recoverable in disputes of that type under the laws of the State of Arizona. This paragraph is intended to be and shall be construed as a forum selection clause, and the parties agree to bound hereto.
